Please read these terms carefully before using our services.

By accessing or using the services provided by Allsorts Web Designers ("we", "our", "us"), you ("client", "user", "you") agree to be bound by these Terms and Conditions.
1 Acceptance of Terms
If you do not agree to these terms, you must not use our services or access our website.
This Agreement is effective from the date you first access our services or sign a project proposal.
2 Services Provided
We provide professional web design, development, SEO, e-commerce solutions, and digital marketing services including:
- Custom website design and development
- WordPress development and customization
- E-commerce store builds and payment gateway integration
- Search Engine Optimization (SEO)
- Website hosting and maintenance
- Graphic design and branding
3 Payment Terms
50% non-refundable deposit required before project commencement.
Remaining 50% due upon project completion, before launch.
EFT, credit cards via Payfast/Yoco. All payments in ZAR.
2% monthly interest on overdue invoices. Services may be suspended.
4 Intellectual Property & Ownership
✓ You Own: All custom code, designs, and assets created specifically for your project upon full payment. This includes HTML/CSS/JS, custom WordPress themes, logos, and domain names registered in your name.
⚠ Third-Party: You do not own third-party assets such as premium themes, stock photos, fonts, or plugins which remain under their original licenses.
Portfolio Rights: We may showcase your project in our portfolio unless you request confidentiality in writing.
5 POPIA Data Protection
We comply with the Protection of Personal Information Act (POPIA):
- We process your data only with consent or as required for service delivery
- We collect only necessary data (name, email, phone, business details)
- Your data is encrypted and hosted on South African servers
- We do not sell or rent your data
- You can access, correct, or delete your data anytime
- We retain records for 7 years as required by SARS
6 Client Responsibilities
You agree to:
- Provide accurate content, logos, and assets for your project
- Ensure you have legal rights to all content you provide
- Respond to requests within 7 business days to avoid delays
- Not use our services for illegal or fraudulent purposes
- Maintain secure login credentials
You are solely responsible for the legality and copyright compliance of content you provide.
7 Hosting & Maintenance
Allsorts Hosting: 99.9% uptime, daily backups, SSL certificates, local SA servers.
No Lock-In: You are free to host elsewhere. We provide full exports upon request.
Maintenance: Optional packages include security updates, plugin updates, and content changes.
Suspension: We may suspend services for non-payment or illegal activity.
8 Warranties & Disclaimers
✓ We Guarantee: 90+ PageSpeed Insights score on desktop.
⚠ SEO Disclaimer: We do not guarantee specific search rankings. Results depend on many factors.
Browser Support: Chrome, Firefox, Safari, Edge. Legacy IE support requires separate quote.
Third Parties: We are not liable for third-party service failures (payment gateways, APIs, etc).
9 Limitation of Liability
To the maximum extent permitted by South African law:
- Our total liability is limited to the amount you paid for the specific service
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for breaches caused by client negligence
- You indemnify us against third-party claims arising from your website content
10 Termination
Client Termination: 30 days written notice. Fees for completed work are non-refundable.
Allsorts Termination: Immediate termination for breach, false information, or illegal activity.
Post-Termination: Pay all outstanding invoices. Files exported within 14 days of payment.
11 Governing Law
This Agreement is governed by the laws of the Republic of South Africa.
Disputes will be subject to the exclusive jurisdiction of South African courts.
We encourage resolving disputes through good-faith negotiation before litigation.
12 Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email to active clients at least 30 days before taking effect.
Continued use of our services after changes constitutes acceptance of the new Terms.
